E-cigarette advocacy group in Malaysia: More time needed to comply with new vaping equipment standards

The Malaysian Vaping Industry Advocacy Group (MVIA) today urged the Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) to extend the deadline for vaping devices to comply with the SIRIM standard.


MVIA also urged KPDNHEP to review and update the standards to comply with international practice.


MVIA's comments follow KPDNHEP's bulletin of trade descriptions (certification and marking) for 2022 vaping device orders under the Trade Descriptions Act 2011, requiring all vaping devices to be tested and apply for SIRIM certification by August 3, 2022.


MVIA president Rizani Zakaria said the association believes the announcement of the introduction of a standard for vaping devices is a step in the right direction as it will protect the safety of users while using vaping devices.


“However, the time frame given to the industry is very short and unreasonable to complete the process. Typically, the entire process of a product being tested and product certified is uninterrupted between three and four months. After the certification process , industry players will have to produce mandatory labels, which will also take time," he said in a statement.


Given the current situation, the MVIA urged the government to give a longer time frame before the end of the year to give the industry enough time to transition and comply, Rizani said.


In addition to asking for an extension, the MVIA also expressed the need to review and update the standards.


“The standards for vaping devices that are being adopted and published were developed in 2018/2019. Since then, vaping devices have also changed and improved significantly due to technology and innovation within the industry. Given this situation, We believe that the authorities need to review and update the standards quickly. This is to ensure that the standards adopted by Malaysia are in line with international practices and standards," Rizani further said.


Furthermore, Rizzani also urged the Ministry of Health (MoH) to quickly issue guidelines and directives on the composition of vaping liquid products, given the delay in submitting a bill to parliament aimed at regulating vaping products.


“While the government has just published standards for the device, there are no regulations for e-cigarette liquids. The Ministry of Health has announced that a bill to regulate e-cigarette liquids will be introduced to Parliament by July this year. In the meantime, products continue to on the market," he said.


“In this regard, the government should immediately issue guidance and directives on the composition of vaping liquid products, especially those containing nicotine, including permissible nicotine levels, and amend the Poisons Act 1952 to allow for the transition of nicotine vaping liquids pending the transition It will be regulated during the period," Rizzani said.


This will further protect the safety of e-cigarette users, who are required to comply with safety and quality standards for nicotine-containing e-cigarette liquids.


At the same time, the government can also collect taxes from the product.
