Bangor, Maine, to repeal flavor ban due to procedural error: no advance notice to retailers

The Bangor, Maine, city council voted unanimously late Monday to repeal its ban on flavored tobacco products, citing a procedural error.


Bangor was the first city in Maine to ban the sale and marketing of flavored tobacco products, and Portland implemented a similar ordinance back in February. Bangor's ban was due to take effect on June 1.


But lawmakers said the city did not follow state law when considering the ordinance, which is stricter than Maine's tobacco retail law and requires 30-day notice to retailers.


Supporters of the flavored tobacco ban have accused the industry of exploiting a decades-old loophole in Maine's law. Representatives from Bangor's school sector have urged council to quickly enact a new ordinance.


“Through our work with students, we’re also very aware that young people in Bangor are not immune to these products, especially since flavored tobacco products are harmful to our most marginalized populations, LGBTQ+ identified students, communities of color and underprivileged students. The impact has been particularly severe," said Tim Surrette, Bangor School Committee member.


Bangor City Councillor Clare Davitt said the council was working on a new ordinance that could begin public discussions as early as next week. The city will notify affected businesses in large numbers, she said.
