The legislation, included in the governor's state budget, would end the sale of menthol cigarettes, flavored cigars and cigarillos, and flavored smokeless tobacco. It expanded the state's ban on the sale of flavored vaping products.

“It’s extremely detrimental,” said Andrew Hyland, director of health behavior at Roswell Park. "Three of every cancer death we see is linked to cigarette smoke."

Flavored tobacco products are marketed to children, Hyland said.

"Studies show that kids who start using menthol products remain tobacco users," he said.

In 2020, the state banned the sale of flavored vaping products, a common alternative to cigarettes, but kept flavored menthol products on store shelves.

"It's the menthol cigarettes that people use," Hyland said. "Approximately 3/4 of one million menthol cigarette smokers in New York State, eliminating this would be a game changer."

The legislation would also impose a $1 tax on cigarette products in New York State.

All of these measures do not apply to the person who sells these products.

Kent Sopris, president of the Convenience Store Association of New York, said: "Instead of impacting smoking rates, smoking bans will hurt small retailers and drive consumers to nearby states, Native reservations and thriving undergrounds market. It would also be disingenuous for the state to propose a ban on flavored tobacco while openly touting grapefruit, pineapple, and tropical cannabis vaping products.

The group also said banning the products would hurt job growth.
