[Two Supreme News] On April 11, at the plenary meeting of the Russian State Duma, more than 90% of the votes supported the "Proposal on Amending Individual Legislative Regulations of the Russian Federation" (hereinafter referred to as the "Proposal"). The proposal aims to tighten the regulation of e-cigarettes in Russia, including the prohibition of e-cigarette flavoring additives.

The bill will take effect on September 1, 2023.

The following is the full text of the proposal:

Proposals for Amending Individual Legislative Regulations of the Russian Federation

Article 1;

In paragraph 1 of Article 14 of Federal Law No. 124-ФЗ "Basic Guarantees of Children's Rights in the Russian Federation" of July 24, 1998 (Russian Federation Legislative Documents, 1998, No. 31, Article 3802; 2008, No. 30, Article 3616; 2009, No. 23, Article 2773; 2011, No. 30, Article 4600; 2013, No. 26, Article 3208; 2020, No. 31, Article 5062 2021, No. 24, Article 4188; 2022, No. 50, Article 8772), replace "or nicotine-containing products" with ", nicotine-containing products, or devices for consuming nicotine-containing products".

Article 2;

In Clause 3, Part 5, Article 5, of the Federal Law No. 38-ФЗ "Advertising Law" of March 13, 2006 (Russian Federation Legislative Documents, 2006, No. 12, Article 1232; No. 52, No. 5497; 2007, No. 16, Article 1828; 2011, No. 30, Articles 4566, 4600; 2013, No. 27, Article 3477; No. 30, Article 4033; Section 6165; No. 52, Section 6981; 2016, No. 27, Section 4214; 2018, No. 15, Section 2032; 2019, No. 18, Section 2217; 2020, Section 31 No. 5062; No. 50, Article 8060; 2021, No. 27, Article 5175; 2022, No. 50, Article 8772), add "including use for Devices for the consumption of products with nicotine content".

Article 3;

In paragraph 2 of Article 9 of Federal Law No. 436-ФЗ of December 29, 2010 "Protection of children from information harmful to their health and development" (Russian Federation Legislative Documents, 2011, No. 1, No. 48; 2015, No. 27, Article 3970; 2020, No. 31, Article 5062), change "or nicotine-containing products" to "nicotine-containing products or devices for consuming nicotine-containing products".

Article 4;

On the Federal Law No. 15-FZ of February 23, 2013 "On the Protection of Citizens' Health from the Consequences of Environmental Tobacco Smoke Exposure, Tobacco Consumption or Consumption of Products Containing Nicotine" (Collection of Laws of the Russian Federation, No. 8 of 2013 , Article 721; No. 1 of 2016, Article 76; No. 18, Article 2491; No. 31 of 2018, Article 4861; No. 31 of 2020, Article 5062; Article 43) Make the following changes

1) In Article 2 Part 1:

2) a) add the words "nicotine-free liquid," after item 3;

3) б) Delete "and nicotine-free or liquids with a minimum content of less than 0.1 mg/ml" in item 4;

4) в) Add the following to item 41: "41) Nicotine-free liquids - any liquid that does not contain nicotine or has a minimum content of less than 0.1 mg/ml, intended for use on devices intended to consume nicotine-containing products, including electronic nicotine Conveyor system;

г) Amend item 12 as follows:

"12) Devices for inhaling nicotine content products - electronic or other devices used to obtain nicotine-containing or non-nicotine aerosol for inhalation by a user, including electronic nicotine delivery systems and heated tobacco devices, and components and components thereof (excluding medical devices and medicines registered in accordance with the laws of the Russian Federation).”

2) Add Part 7 to Article 13, which reads as follows: "7. The sales price of nicotine-containing products shall not be lower than the minimum price of nicotine-containing products. The minimum price of nicotine-containing products shall be established by the Government of the Russian Federation
