The decision marks the first time that the agency has approved the sale of e-cigarette brands in the United States, but the approval does not include some flavoring products under the Vuse Solo brand submitted by RJ Reynolds Vapor Co..

The FDA obtained the authority to supervise new tobacco products in 2009. In the past ten years, thousands of e-cigarettes have appeared on store shelves without the approval of the agency, which has allowed these products to be sold as they gradually become the standard in emerging industries.
