FDA approves the sale of Vuse vaping products, the first in the e-cigarette industry

The US Food and Drug Administration announced on Tuesday that it will allow a division of British American Tobacco to continue to sell its Vuse Sole e-cigarettes in the United States. The decision marks the first time that the agency has approved e-cigarette brands to be sold in the United States. However, the approval does not include some flavoring products submitted by RJ Reynolds Vapor.


The agency's decision seems to indicate that the FDA is concerned about flavored e-cigarette products favored by teenage users.


Text: The U.S. Food and Drug Administration announced on Tuesday that it will allow a division of British American Tobacco to continue selling its Vuse Sole e-cigarettes in the United States. The decision is part of the agency’s broader review of the e-cigarette industry. The FDA obtained the authority to regulate new tobacco products in 2009. In the past decade, thousands of e-cigarettes have appeared on store shelves without the agency’s approval, which has allowed these products to be sold as they gradually become the standard in emerging industries.

Nicotine is the addictive ingredient of tobacco, and it may have other negative effects on health. The FDA is reviewing approximately 6.5 million applications from approximately 500 companies and has not yet issued a ruling on all of these products. Tens of thousands of applications from small companies such as JD Nova Group and Great American Vapes were rejected, especially for flavored e-cigarette products.


The JUUL brand, which once dominated the market, has yet to make a decision. JUUL used to sell fruity flavors such as mango, but suspended sales of these products in October 2019. Currently selling tobacco and menthol flavors. (Altria, owner of Marlboro, owns 35% of Juul.)


In Tuesday’s decision, the FDA stated that it knows that 10% of high school students who use e-cigarettes named Vuse as their favorite brand in the 2021 National Youth Tobacco Survey.


In 2019, federal data found that more than a quarter of high school students had used e-cigarettes in the past 30 days, up from 11.7% two years ago. By last year, due to increased regulatory review and the coronavirus pandemic, this number had dropped to 19.6% of high school students.


"The agency takes these data very seriously and considers the risks to young people when reviewing these products," it said. However, it believes that the data shows that many young e-cigarette users are beginning to use products with flavors such as candy, fruit or mint.


"These data strengthen the FDA's decision to approve tobacco-flavored products because these products are less attractive to young people, and approval of these products may be beneficial to adult burning cigarette users," it said.


The approval of Vuse Solo has been criticized by anti-tobacco groups. The American Lung Association said it was "disheartened" by the FDA's decision.


The organization said in a statement that youth e-cigarette smoking is still at a critical level. "To completely remove high-nicotine products like Vuse from the market and stop selling all flavored e-cigarette products, including menthol, is a clear way to end the youth e-cigarette epidemic," ALA said.
