Illinois bill would ban flavored e-cigarettes, including THC

The flavor ban bill introduced in the U.S. state of Illinois would also ban flavored THC vaping devices. Senate Bill 3854, introduced in January, is currently under committee consideration. Any flavored vaping products, including heat-not-burn systems and tobacco chews, will be banned.


The Act provides that: (1) tobacco products include products containing THC and products containing mixtures of THC and nicotine, and (2) tobacco retailers include dispensing establishments and dispensing establishment agents, terms that are used in the Cannabis Act Statutes and Tax Acts are defined in. It is assumed that a tobacco product, related tobacco product, alternative nicotine product, or solution or substance intended for use with an e-cigarette is a prohibited product, solution or substance intended for use with an e-cigarette if it has or produces a characteristic flavor.


A consumer advocacy group said the measure did more harm than good.


According to KPVI, Elizabeth Hicks, U.S. affairs analyst at the Center for Consumer Choice, said a flavor ban on vaping products at a time when smoking rates in Illinois are trending downward will prompt adult consumers to switch back to Smoking combustible tobacco.


"About 12 percent of adults reported smoking in 2020, but we can certainly expect that number to increase if this bill passes," Hicks said. "This will ultimately lead to increased smoking-related health care costs, which already cost Illinois taxpayers more than $1.9 billion a year," Hicks said.


Illinois passed two laws last year aimed at making vaping products more difficult for minors. The first law (Senate Bill 512) bans the use of cartoon characters, video game characters, and popular children's media in e-cigarette advertising. It also makes it more difficult to buy vaping products online. Buyers must now use a credit card or register in the buyer's name.


The second law (Senate Bill 555) amended the Substance Use Disorders Act to include vaping shops. Allows the Illinois Department of Human Services to conduct compliance inspections of e-cigarette sales based on a minimum purchase age of 21.
