Logic Technology Development obtained a court order from the U.S. Court of Appeals for the 3rd Circuit temporarily suspending a Marketing Denial Order (MDO) from the U.S. Food and Drug Administration.
The temporary suspension issued by the Circuit Court means that both Logic Pro Menthol e-Liquid packaging and Logic Power Menthol e-Liquid packaging products can be sold by retailers and wholesalers in the United States during the suspension period.
According to media reports, the Third Circuit will now consider Logic's further motions for the MDO, which the company has seven days to file.
"The motion for partial administrative stay described above is granted as follows. FDA's marketing denial order for the Logic Pro Menthol e-Liquid Package and Logic Power Menthol e-Liquid Package products has been placed on hold. Within 7 days of the order being issued, the petitioner must file a stay motion to apply," the order said. "The FDA response must be submitted within ten days thereafter."
"A panel considering a stay motion can make a decision without waiting for a response, so any response must be submitted as soon as possible (and no later than three days after the response)."
The temporary administrative stay will remain in effect until a court panel decides on Logic's new stay motion. Authorizes and instructs the clerk to withdraw the temporary administrative stay if a motion to stay is not filed in a timely manner.
