Government of Canada Shares Results of First Tobacco and Vaping Products Act Legislative Review

Carolyn Bennett, Canada's Minister of Mental Health and Addiction and Deputy Health Minister, introduced the Tobacco and Vaping Products Act (TVPA) in Parliament. The review focuses on the vaping-related provisions of the TVPA, which include an obligation to conduct a legislative review three years after it goes into effect, followed by a follow-up review every two years.


Based on public consultation and available evidence, including peer-reviewed scientific journal publications, population surveys, and opinion studies, the findings of the review indicate that the TVPA is making progress towards the goals it has set in relation to vaping.


It is worth noting that the rate of e-cigarette use among young people, which has been rising rapidly in the past two years, has leveled off in the past two years, but it is still at a relatively high level, and more work needs to be done to protect young people. people.


The review also identified areas for possible action, including examining youth access to vaping products, promoting the potential benefits and health harms of e-cigarettes as a less harmful source of nicotine for people who smoke and switch entirely to vaping, strengthening cooperation regulation and enforcement, and address scientific and product uncertainties to better understand the vaping product market and the health effects of vaping.


The Government of Canada continues to work with partners and key stakeholders to use the best available data and evidence to protect Canadians from the harms of smoking and nicotine addiction.


Carolyn Bennett said vaping products provide 3.8 million Canadians with a less harmful source of nicotine than tobacco products and do help people quit smoking. However, these products are not without risks - especially for young people and non-smokers. This first legislative review of the Tobacco and Vaping Products Act is a valuable opportunity to take stock of the progress we have made in addressing youth vaping – but there is more work to be done. Our government will continue to work hard to put in place the right safeguards to protect young people from vaping and nicotine addiction.


"We are committed to using all the tools at our disposal to protect young people and non-smokers from vaping and nicotine addiction," said Canadian Health Minister Jean-Yves Duclos. As vaping continues to pose complex public health challenges; TVPA plays an important role in supporting public education and regulations that can help reduce vaping rates among Canadian youth. Building on the comments received through this review, we will continue to strengthen the TVPA to address youth vaping.

The TVPA was implemented in 2018 in response to the growing number of vaping products in Canada and to help ensure Canadians are aware of and protected from the health hazards associated with vaping. It regulates the manufacture, sale, labeling and promotion of vaping products sold in Canada.


The TVPA requires a legislative review three years after it goes into effect and every two years thereafter. Periodic reviews provide a means to examine and respond to tobacco and/or vaping-related issues that may arise over time.


The review was the result of a public consultation running from 16 March 2022 to 27 April 2022. Canadians are encouraged to provide feedback on the TVPA Legislative Review Discussion Paper. Health Canada received 3,092 submissions as part of the public consultation.


Health Canada provided financial support to the Center for Addiction and Mental Health to develop guidelines for low-risk nicotine use. The guidelines recommend that smokers should first try to quit using an approved smoking cessation treatment. If they are unable or unwilling to quit smoking, e-cigarettes or e-cigarettes may be considered.


The TVPA supports the goals of Canada's Tobacco Strategy, including helping smokers quit and protecting youth and non-tobacco users from nicotine addiction.
