In a court filing this week, the FDA said it may not be able to complete premarket tobacco product application (PMTA) reviews for some of the most popular e-cigarettes on the market until Dec. 31, 2023 program.
After learning of the delay, Senator Dick Durbin of Illinois began demanding immediate action from the FDA to remove e-cigarettes and vaping products from store shelves, saying the agency was ignoring courts that required them to act by September 2021 Order.

“Despite FDA indecision, hesitation and delay, more than a million American children have started vaping,” Durbin said this week, calling on the agency to comply with the court order. "Not next year. Not next month. Immediately, today," Durbin said in a release.
