However, recently, the U.S. District Court ordered its local distributor to stop the sales of ELFBAR electronic cigarettes in the United States. The cause was the temporary injunction proposed by VPR Brands, LP (VPR) in suing ELFBAR for trademark infringement. The claim was granted by the U.S. District Court for the Southern District of Florida.

ELFBAR then immediately appealed the temporary injunction issued by the District Court to the U.S. Court of Appeals for the Federal Circuit, and asked the District Court to suspend the execution of the temporary injunction during the appeal period. At the same time, a distributor of ELFBAR also filed an application for cancellation of VPR's ELF registered trademark to the Trademark Trial and Appeal Board of the United States Patent and Trademark Office. In addition, the trademark litigation in the United States will not affect the registration and use of the original ELFBAR trademark in China and other markets.

In this regard, the legal representative of ELFBAR said in response to the reporter's interview: "During the litigation process of this case, we have been firmly defending our legal rights and maintaining active communication with our channel partners. Continue to defend our rights resolutely."

According to the legal representative, VPR filed a joint lawsuit against ELFBAR and several distributors in October 2022, accusing its ELF trademark and patent of infringement. In the past two years, VPR has filed lawsuits against several manufacturers and distributors of disposable electronic cigarette products, claiming that the patents it asserts have been infringed, but often when the respondent contests the legitimacy of the case. withdraw the lawsuits, or settle the cases for relatively small sums.

ELFBAR further stated, "While we are disappointed by the district court's decision, our well-recognized design trademarks, legally registered in the U.S. and familiar to consumers, will continue to represent our beloved consumer brand."
