UK regulators have confirmed some of Lost Mary's disposable vaping products are illegal and urged retailers to remove them immediately.
In a letter dated March 15, the Chartered Trading Standards Institute (CTSI) and the Medicines and Healthcare Products Regulatory Agency (MHRA) revealed that more information had been exchanged to identify more affected batches, including some Lost Mary products.
BetterRetailing has confirmed for the first time that Booker and One Stop voluntarily withdrew their Lost Mary disposable vaping products last month due to manufacturing quality issues.
At the time, the batch affected was related to its BM600 device and included Blueberry, Blue Razz Ice, Blueberry/Tart Raspberry, Marshmallow, Double Apple, Kiwi Passion Fruit Guava, Mary Cow Ice, Pink Lemonade, Strawberry Ice, Triple Mango, Triple Melon and Watermelon Ice flavors.
However, in a recent communication, the regulator said grape and cola flavors in its QM600 products were also found to be non-compliant.
CTSI and MHRA reiterated that there is no indication that overfilled products pose a greater health risk when used normally, but stressed that substandard products must not be sold to consumers.
It went on to add that if non-compliant batches of product are still on the shelves, whether action should be taken is always a local decision, depending on local priorities, competing needs and available resources.
The news comes days after BAT test data leaked that nearly all major disposable e-cigarette brands contained illegal levels of e-liquid.
The tobacco manufacturer wrote to the wholesaler explaining that it had commissioned independent accredited laboratories to test Elfbar 600 products purchased from supermarkets and independent retailers between 6 September 2021 and 7 March 2023.
Evidence showed that the products tested contained nicotine-containing e-juice significantly above the legal limit of 2ml from 2.76ml to 3.88ml, with an average spillage of 58%.
Following the ongoing scandal, the CTSI and MHRA have confirmed that a compliant replacement product has arrived in the UK.
