According to a press release, the US Food and Drug Administration has issued warning letters to 189 retailers selling unauthorized products, especially Elf Bar and Esco Bars.
FDA Commissioner Robert M. California stated, "The FDA is prepared to use all its powers to ensure that these and other illegal and attractive products do not fall into the hands of children." We are committed to adopting a multi-pronged approach, utilizing regulatory, compliance, and enforcement actions, as well as education, to protect young people in our country
The FDA stated that these warning letters are the result of surprise inspections of retailers nationwide in the past few weeks.
Brian King, director of the FDA Tobacco Products Center, said: "All participants in the supply chain (including retailers) have the responsibility to prevent illegal Electronic cigarette from being taken off the shelves." "The latest Blitzkrieg should ring the alarm bell for Elf Bar and Esco Bars product retailers nationwide. If they are waiting for personal invitations to comply with the law, they may only receive FDA warning letters or other forms of action."
Elf Bar and Esco Bar products did not obtain the marketing authorization required by the FDA. So far, FDA has approved 23 kinds of Electronic cigarette products and equipment with tobacco flavor. The distribution and sales of illegally marketed products will be subject to compliance and enforcement actions.
As of June 16, FDA has sent more than 570 warning letters to companies that manufacture, sell and/or distribute illegal tobacco products, including Electronic cigarette, and filed civil fines complaints against 12 Electronic cigarette manufacturers.
