British e-cigarette regulator updates e-cigarette product sales guidelines

After discussions with the British Electronic Cigarette Industry Association (UKVIA) and trade standards, the government agency responsible for overseeing the UK’s e-cigarette notification program and implementing the Tobacco and Related Products Regulations (TRPR) updated its guidelines on the sale of e-cigarette products.

After contacting a large number of e-cigarette product manufacturers, distributors and retailers, UKVIA decided to intervene, because e-cigarette retailers are confused about what can and cannot be legally sold in stores, especially in the new one that has recently entered the UK market. After the surge in electronic cigarettes.

As a result, the Medicines and Healthcare Products Regulatory Agency (MHRA) has now clarified its recommendations to manufacturers and distributors of e-liquids and devices, as well as e-cigarette retailers.

After retailers were unsure of their compliance requirements and worried about breaking the law, UKVIA participated in discussions with MHRA and trade standards.

“Since we have received a large number of inquiries about the legality of newly listed products in stock, especially the surge in new disposable products, we decided that it is necessary to talk to trade standards and raise this issue with MRHA for clarification.” UKVIA General Manager Secretary John Dunne said in a statement.

"Since then, we have been working with MHRA to clarify the process of when the product can be legally put on the market for sale. The first part saw the MHRA issued an electronic bulletin, clearly stipulating the process, and clearly stated on the MHRA website Before the “ECID” number was “Approval/Declaration”, it was illegal to put the product on the market. Next, MHRA updated its online advice to retailers, which was a very satisfactory result because it effectively blocked The loopholes of when brands can put their products on the market and when retailers can legally sell their products have survived."

The MHRA's guidance to e-cigarette retailers previously stated:

"When purchasing any new supply of e-cigarettes or e-liquid products, please check whether the detailed information of the product notification has been posted in the notified product list. If you cannot find the product on the MHRA website, please ask your The supplier confirms that the product complies with TRPR and has notified MHRA. If the manufacturer does not notify the product or the product does not comply with TRPR, they may not supply it to you."

The new wording says: “When purchasing any new supply of e-cigarettes or e-liquid products, please check whether you have posted a compliance notice in one of the above notified product lists. If you can’t find it on the MHRA website The product, please ask your supplier to confirm that the product has been released and provide detailed information so that you can confirm the status of the product. If the product has not reached the released status, they may not provide it to you."

Dunn said that clarification shows the effectiveness of open dialogue. "We hope that our industry is known for adhering to strict standards in the manufacturing, distribution and sales of e-cigarette products, and this clarification by MHRA will not make anyone doubt their responsibilities." He said.
