The British Advertising Practice Council (CAP) recently issued an executive notice, requiring Electronic cigarette companies to comply with advertising regulations and remove Electronic cigarette advertisements appearing on social media.
CAP noticed that some brands published content related to Electronic cigarette products and their components on TikTok, and even took incentive measures to let third parties publish such content. CAP has warned all brands to take targeted law enforcement actions if the problem persists.
According to laws and regulations, there are significant restrictions on the advertising of Electronic cigarette. These limitations are reflected in the Advertising Code of Conduct. The nicotine containing Electronic cigarette advertisement without drug license shall not be put on TV, radio, newspapers, magazines and most online media, including social media. Advertising must be responsible, including not specifically targeting people under the age of 18.
CAP said that it has learned that people are concerned about young people's use of Electronic cigarette and their advertisements on social media. Therefore, action is being taken to prohibit advertisements that violate regulations and ensure their prompt removal. CAP is working with other regulators and law enforcement agencies to ensure that young people will not be exposed to Electronic cigarette advertisements that should not appear on TikTok and other social media.
The executive notice clearly informed advertisers/brands of the current regulations, and required that if they use TikTok platform for Electronic cigarette advertising, they must stop immediately.
Finally, CAP reiterated that its responsibility is to ensure that Electronic cigarette advertising can only appear in places where it can be legally launched (for legal adult audience) and that it is responsible. Currently, these advertisements sometimes appear on social media and target young people.
